Eligibility: Per IC 12-10-3-2 An endangered adult is anyone over the age of 18 who is incapable by reason of mental illness, mental retardation, dementia, habitual drunkenness, excessive use of drugs, or other physical or mental incapacity of managing or directing the management of the individual’s property or providing or directing the provision of self-care and is harmed or threatened with harm as a result of: neglect, battery or exploitation. An individual is not an endangered adult solely: for the reason that the individual is being provided spiritual treatment in accordance with a recognized religious method of healing instead of specified medical treatment if the individual would not be considered to be an endangered adult if the individual were receiving the medical treatment; or on the basis of being physically unable to provide self care when appropriate care is being provided.

APS also has a duty to report law that is similar to the one Child Protective Services has. It is a Class B Misdemeanor with a $1,000 fine and up to 180 days in jail for not making a report to APS or police when you have a reason to believe that another individual is an endangered adult.

Program Details

Bill Payer Program
: Trained volunteers to assist with general banking procedures such as: balancing accounts, check writing, and setting up monthly budgets. 
Population served: Disabled, homebound, forgetful or confused person in an effort to help them maintain as much independence as possible. This person does not need the services of a permanent representative payee or a legal guardian. Participation is voluntary on the part of the client.
Representative Payee Project: The volunteer, after training, the matched volunteer and client establish a working relationship. Once established, the volunteer applies to the SSA to be a representative payee on behalf of the client. The money is deposited directly into the bank account, and the Representative then pays the client’s bills from that account.
Population served: Individuals who are determined by a physician as incapable of managing their own monetary affairs and who do not have friends, relatives or others who can help them with managing their finances. They receive federal benefits and have been determined by the appropriate federal office to need a representative to pay expenses associated with their basic needs. They will be low-income people most vulnerable to financial exploitation or neglect; they may be isolated, and have mental or physical disabilities.
The program was established in 1993 by the Legal Counsel of the Elderly, a division of the American Association of Retired Persons in cooperation with the Social Security Administration (SSA).
  • Uses volunteers.
  • Volunteers are screened and trained by the program. 
  • Qualifications are doubled-checked by the SSA before allowing services. 
  • AARP/LCE insures the bank account against loss or miscalculations. 
  • The account is audited monthly for accuracy and appropriateness. 
  • Volunteers are limited to handling only social security and/or other government benefits. Private income/other resources are outside the scope of the program.
Financial Management Program
Assists seniors to learn how to deal with creditors, identifies options to help move through the situation, and provides lists for attorneys and other helpful resources.

Additional Information: Provides a half hour of free and confidential consultation sessions with Lafayette attorney David Rosenthal, designed to help seniors avoid bankruptcy, or otherwise difficult financial situations. Telephone conferences are also an option during this same period of time each month.
